QUOTATION, RATES & CHARGES

All prices are in GBP and are exclusive of VAT, at the current rate, unless otherwise stated.

All quotations are estimated journey charges, are valid for 30 days and do not include waiting time, parking, tolls or TFL Congestion Charge.

Gratuities are at the Customer’s discretion. Waiting time is charged at the agreed tariff rate.

Final journey charges will be calculated according to the actual route taken by the chauffeur and any other relevant factors, e.g. waiting time (at the agreed tariff)

The chauffeur will take the most optimal route, unless the client gives specific instructions or prevailing traffic conditions dictate.

Charges apply for Customer “no shows” and cancellations at the tariff rate based on the service booked. Cancellation notice periods are as follows:

ALL vehicles in the UK:    2 hours or if the driver has left base and is on route.

If you cannot locate your chauffeur and you seek an alternative method of transport without first contacting The Yorkshire Chauffeur to try and resolve the situation, you will be charged the tariff rate based on the service booked.

Surcharges will apply on Bank Holidays as follows:

Christmas Day, Boxing Day, New Year’s Eve and New Year’s Day: 100%

All other Holidays: 50%

In the event that the interior of the vehicle is soiled or damaged by the Customer, a valeting charge of £100.00 will apply.

Yorkshire Chauffeurs reserves the right to review the charges to take account of movements in the Retail Price Index, currency fluctuations, fuel, legislative changes or any other charges outside of our control.

All bookings made shall be deemed to be a confirmation by the Customer to acceptance of these terms and conditions and shall supersede any others. Any amendments to these terms and conditions must be agreed in writing by both parties.

PAYMENT

Invoicing

EOM (End of Month) invoices will be sent, by e-mail, to accounts payable or preferred e-mail address(es) on the final day of the corresponding month and provide a comprehensive list of all bookings undertaken and relevant charges.

Payment terms are strictly thirty days net (NET30) from date of invoice, unless stated in contractual terms.

The due date of invoices is thirty (30) days from invoice date.

DISPUTES

Any disputes with an invoice must be raised with the Yorkshire Chauffeurs accounts team no later than fourteen (14) days from date of invoice.

LATE PAYMENT

In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, Yorkshire Chauffeurs reserves the right to charge statutory interest at eight percent (8%) above the current Bank of England interest rate on invoices that are paid late and therefore overdue.

In accordance with the Late Payment of Commercial Debts Regulations 2013, Yorkshire Chauffeurs reserves the right to charge statutory debt recovery charges, as below:

Up to £999.99                                       £40.00

£1000.00 to £9,999.99                      £60.00

£10,000 or more                                  £100.00

Failure to comply with these terms and conditions could result in Yorkshire Chauffeurs pursing a County Court Judgement (CCJ) for unpaid invoices and this may affect your credit rating. This does not affect your statutory rights.

TERMS AND CONDITIONS OF SALE

These terms and conditions are governed by and are subject to the laws of England and Wales, Yorkshire Chauffeurs and the Customer submit to the exclusive jurisdiction of the courts of England and Wales.

EXCLUSIONS

Yorkshire Chauffeurs accepts no responsibility for any loss or damage to property. In the event of property being left in a vehicle, we will gladly organise the return of such items. This service may be chargeable.

Yorkshire Chauffeurs shall be under no liability to the Customer whatsoever for any indirect loss and/or expense (including loss of profit) suffered by the Customer arising out of a breach by the Company of these terms and conditions.

In the event of any claim against Yorkshire Chauffeurs arising out of its performance of hire, the Company’s liability shall be limited to a refund not exceeding the cost of the journey. Any other payments will be entirely at the discretion of the Company.

NON-SOLICITATION OF PERSONNEL

If you wish to directly hire or employ a Yorkshire Chauffeurs driver, we reserve the right to levy a £5000.00 fee to cover the costs of recruiting and training a replacement chauffeur.

DATA PROTECTION

Yorkshire Chauffeurs is registered with the Information Commissioners Office with Certificate of Registration number C1170316 and is compliant with the General Data Protection Regulation (EU) 2016/679 (EU GDPR), Yorkshire Chauffeurs is the authorised Data Controller and our use of personal information, supplied by you, is governed by our relevant privacy policy. To provide our service to you, as a customer of Yorkshire Chauffeurs, we may require you to provide certain information to us. Common items may include, but are not limited to, the booker and/or the passenger’s name(s), address(es), contact telephone number(s), e-mail address(es) and payment card details. By providing this information to Yorkshire Chauffeurs, you are agreeing to allow us to utilise this information to complete all services you request to us.

We will NEVER pass your personal information to, or allow access to your personal information by third party service providers or organisations. We may however, disclose or process personal and sensitive data to organisations where we have a legal obligation to do so.

INTELLECTUAL PROPERTY RIGHTS

Yorkshire Chauffeurs name, strapline and logos are registered trademarks and may not be used without Yorkshire Chauffeurs’ written permission.

You acknowledge that the copyright, trademark rights, database rights, patent rights and all other intellectual property rights comprised in or relating to Yorkshire Chauffeurs, including but not limited to text, graphics, audio, video or image files, content, software, data and information displayed on, or available from our website, belongs to Yorkshire Chauffeurs.

If your conduct causes us loss, damage or other costs, you shall be responsible for reimbursing these costs.

You agree NOT to make any un-authorised, false or fraudulent orders, reservations or request for our services.
